In Montenegro, the legal profession is an independent and autonomous activity that provides legal assistance to individuals and organizations.

Only individuals with a Bachelor of Laws degree (from a 4-year course) are eligible to practice law. Upon passing the bar and attorney exams, and admission to the Bar Association, a lawyer can be enlisted as an attorney-at-law.

The autonomy and independence of the attorney-at-law profession are ensured by:

  • Independent practice of the legal profession,
  • The client's right to choose their own attorney-at-law,
  • The organization of attorneys-at-law in the Bar Association of Montenegro as autonomous and independent organizations,
  • The adoption of general legislation by the Bar Associations,
  • Decision-making on admission to the Bar Associations and the termination of the right to practice law under the reference of the attorney-at-law.

The provision of legal assistance includes, inter alia:

  • Providing oral and written legal advice and opinions,
  • Drafting legal documents such as petitions, requests, contracts, testaments, etc.,
  • Representation and defense of individuals and legal entities,
  • Mediation for legal transactions or the peaceful settlement of disputes,
  • Providing other legal assistance on behalf of national or foreign individuals or organizations.
